Your rights in the event of flight cancellation

You might be eligible to receive up to 4,500 kr in compensation from the airline if you’ve experienced a flight cancellation within the past 3 years. However, you should be aware that the airline can drop your compensation claim if the cancellation occurs under “exceptional circumstances”, which you can read more about below. You are also not entitled to compensation if the airline has informed you of the cancellation at least two weeks before departure.

Compensation for flight cancellations

The flight cancellation compensation is stated directly in the law, which shows that you are entitled to compensation from the airline if your flight has been delayed more than two hours. According to (EC) No. 261/2004 of February 11th 2004, you might actually be entitled to up to 4,500kr (600€) in compensation if the delay is due to a canceled flight.

You should be aware that the delay must exceed two hours in order for you to be compensated. Two hours from the original arrival time compared to the actual arrival time, eg.: Original arrival 07.00, actual arrival 13.00 = 6 hour delay. The arrival time is calculated from the time when you have the opportunity to leave the plane, and not the time the plane lands.

What does “exceptional circumstances” entail?

Passengers are not entitled to compensation if the reason for the cancellation is extraordinary circumstances that could not have been avoided even if the airline had taken reasonable measures.

The following circumstances are all considered “exceptional circumstances”:

  • No-fly order – Required
  • Weather conditions – Jeopardize safety
  • Illness/problems with other passengers
  • Strikes – No matter the reason
  • Terrorist/military coup

As an airline passenger you should however be aware that the airline will often try to avoid their obligation when it comes to compensation. This is done by, for example, justifying the reason for the cancellation by saying it is an exceptional circumstance. Statue of limitation for flight cancellations

If you’ve been unfortunate enough to experience a flight cancellation within the past 3 years, you may be entitled to financial compensation of up to 4,500kr for the losses any potential losses you might have suffered in connection with the flight cancellation. The  statute of limitation for these type of cases is in Denmark 3 years, so you’re more than welcome to contact us regarding cases that are up to 3 years old.
